1. Agreement to Terms

By accessing or using gotplenty.ai or any related applications, content, or services (collectively, the "Service"), you ("you," "User") agree to these Terms of Use ("Terms") and to our Privacy Policy. If you do not agree, please do not use the Service.

These Terms are between you and Love and Optimism, LLC, a Delaware limited liability company ("we," "us," "our").

2. Changes to Terms or Pricing

We may modify these Terms or our pricing at any time, in our sole discretion. If we make material changes, we'll notify you (for example by email, notice within the Service, or updated posting). Your continued use of the Service after such changes means you accept them. We reserve the right to introduce, modify, or discontinue features, plans, or pricing without notice.

3. Description of the Service

gotplenty.ai is a digital tool that helps users track food, health habits, and behavioral patterns. The Service may allow users to upload or submit photos of food, notes, or reflections on eating habits, health goals, or related behaviors. We are not a medical provider, and the Service does not offer medical advice, diagnosis, or treatment.

The Service generates responses and insights using AI. Such responses and insights may be incomplete, inaccurate, or not appropriate for your specific circumstances, and are provided for informational purposes only.

You should consult a qualified healthcare professional before making any changes to diet, exercise, or other health routines.

4. Use of the Service

4.1 Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.

4.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal use, including use as part of a coaching or guided program, in accordance with these Terms.

4.3 Prohibited Conduct

You agree not to:

• use the Service for any unlawful, abusive, harassing, or fraudulent purpose;
• submit false, misleading, or harmful information;
• upload or share any content that is obscene, defamatory, or infringes the rights of others;
• attempt to reverse engineer, copy, or exploit the Service for unauthorized purposes;
• interfere with other users' enjoyment of the Service.

We reserve the right to suspend or permanently remove your account if we determine, in our sole discretion, that your use violates these Terms or otherwise harms the integrity of the Service or community.

5. User Content

You may upload or submit photos, text entries, and other materials ("User Content"). You retain ownership of your User Content, but by submitting it, you grant Love and Optimism, LLC a worldwide, royalty-free, non-exclusive license to use, store, process, analyze, and display your User Content as necessary to operate and improve the Service.

You acknowledge that:

• your photos and data may be used to generate insights or analytics for your own use;
• we may use anonymized or aggregated data (that cannot identify you) to improve features or for research and analytics;
• you are responsible for ensuring your content complies with applicable laws and does not infringe others' rights.

• If you access the Service through an invitation from a coach or participate in the Service as part of a coaching or guided program, you authorize Love and Optimism, LLC to share your content and activity with that coach for coaching and support purposes.
• You may discontinue participation in a coaching program at any time. After you do so, new information generated through the Service will no longer be shared with the coach, though information previously generated may remain accessible to the coach, including as part of a final data export.

6. Intellectual Property

All materials, software, text, graphics, and designs made available through the Service are the property of Love and Optimism, LLC or its licensors. You may not reproduce, distribute, or create derivative works from the Service without our written permission.

7. Disclaimers and Limitation of Liability

The Service is provided "AS IS" and "AS AVAILABLE." To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express or implied, including any warranty of merchantability or fitness for a particular purpose.

We make no guarantee about the accuracy or usefulness of any information or insights generated through the Service. You acknowledge that any decisions you make based on information from gotplenty.ai are your own responsibility.

In no event will Love and Optimism, LLC be liable for any indirect, incidental, consequential, or special damages, or for any loss of data, profits, or goodwill. Our total liability for any claim will not exceed $100 or the amount you paid us in the past twelve (12) months, whichever is greater.

Our total liability for any claim will not exceed the lesser of: (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100).

8. Termination

You may stop using the Service at any time. We may suspend, terminate, or delete your account at any time, with or without notice, if you violate these Terms or for any reason we deem necessary to protect the Service or other users.

Sections related to Intellectual Property, Disclaimers, Limitation of Liability, and Dispute Resolution will survive termination.

9. Dispute Resolution and Arbitration

Any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, on an individual basis. You and Love and Optimism, LLC each waive the right to bring claims in court or to participate in a class or collective action. Arbitration will be conducted remotely unless the parties agree otherwise.
